Terms of Service

By accessing or using Reachly AI ("the Service"), you agree to be bound by these Terms of Service. If you do not agree, you must not use the Service.

These Terms constitute a legally binding agreement between you and Krrisp Pty Ltd (ACN: 609 221 570), the operator of Reachly AI.

To use Reachly AI, you must:

• Be at least 18 years of age
• Have the legal capacity to enter into a binding agreement
• Use the Service for legitimate business purposes only
• Comply with all applicable Australian laws and regulations

Reachly AI provides Verifications, not Lists. We are a verification engine that validates business contact information against live, authoritative sources including the Australian Business Register (ABR) and professional networks.

Credits are consumed only upon a successful 'Reveal'—the moment you unlock verified contact details for a specific lead. Browsing, filtering, and previewing leads does not consume credits.

Each Reveal triggers our proprietary Verification Waterfall, which cross-references multiple data sources to ensure accuracy before delivering contact information to you.

All payments are processed securely via Stripe. Prices are displayed in Australian Dollars (AUD) and include GST where applicable.

Credit packages have defined validity periods:

• The Pilot Pack: 4 months validity
• The Growth Engine: 9 months validity
• The Scale Accelerator: 14 months validity

Rollover Benefit: If you purchase a new credit pack before your current pack expires, your existing credit balance will roll over into the new validity period.

Credits that expire without rollover cannot be refunded or reinstated.

We stand behind the accuracy of our verifications. Under our Truth Guarantee, credits will be refunded in the following circumstances:

• Technical Bounces: If an email address we verified results in a hard bounce (permanent delivery failure)
• Role Changes: If a contact has left their stated role at the company

To claim a refund, you must report the issue within 48 hours of the Reveal, providing evidence of the bounce or role change.

This guarantee constitutes our primary 'Fitness for Purpose' commitment under the Australian Consumer Law (ACL). We do not guarantee response rates, conversion rates, or any commercial outcome from your outreach activities.

Accuracy: You are responsible for providing accurate account information and maintaining the security of your login credentials.

Access: You must not share your account credentials or allow unauthorised access to your account. Each account is for a single user unless otherwise agreed.

Compliance: You warrant that you will use all data obtained through Reachly AI in full compliance with:

• The Spam Act 2003 (Cth)
• The Privacy Act 1988 (Cth) and the Australian Privacy Principles
• Any other applicable laws, regulations, and industry codes of conduct

All data processed through Reachly AI is hosted on Australian-based infrastructure (Sydney region, ap-southeast-2). Your data never leaves Australian shores.

We comply with all Australian data sovereignty requirements and the Australian Privacy Principles.

To the maximum extent permitted by law, the total liability of Reachly AI and Krrisp Pty Ltd for any claim arising out of or relating to these Terms or your use of the Service is limited to the amount you paid for the specific credit pack in question.

We are not liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities.

Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including liability under the Australian Consumer Law for failure to comply with consumer guarantees.

You agree to indemnify, defend, and hold harmless Krrisp Pty Ltd, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses arising out of or in any way connected with:

• Your use of the Service
• Your violation of these Terms
• Your violation of any applicable law or regulation
• Your misuse of verified data, including sending unsolicited communications

Users acknowledge that some leads may be unavailable for Reveal due to individual privacy opt-outs. Professionals have the right to request suppression from our verification engine via our opt-out page.

If a lead is suppressed, the Reveal will be blocked and no credit will be deducted from the user's account.

These Terms are governed by and construed in accordance with the laws of New South Wales, Australia.

You agree to submit to the exclusive jurisdiction of the courts of New South Wales and any courts that may hear appeals from those courts for any proceedings in connection with these Terms.

We may update these Terms from time to time. If we make material changes, we will notify you by email or by posting a notice on our website prior to the changes taking effect.

Your continued use of the Service after any changes constitutes your acceptance of the new Terms.
